ESTATE PLANNING DOCUMENTS

Homeowners

Last Will and Testament

A will is a legal document that outlines how a person's assets and belongings should be distributed after their death. It allows individuals to designate beneficiaries, appoint an executor to manage the estate, and make specific instructions for guardianship of minor children. A will ensures that a person’s wishes are honored, minimizing confusion and potential disputes among family members during a difficult time. Without a will, state laws will dictate how assets are distributed, which may not align with personal preferences.

Health Care Power of Attorney

A healthcare power of attorney is a legal document that appoints someone to make medical decisions on your behalf if you become incapacitated and unable to communicate your wishes. This trusted person, known as your healthcare agent, is responsible for ensuring that your healthcare preferences are followed, including treatment options and end-of-life care. Having a healthcare power of attorney in place provides clarity and peace of mind, ensuring that decisions are made in line with your values, even when you cannot voice them yourself.

It specifies if life-sustaining treatments should we withdrawn and when. A living will, is also called an advanced directive and is often included inside of a healthcare power of attorney.  Both of these documents provide clarity and ensures that your healthcare choices are respected, offering peace of mind for both you and your family during difficult times.
